Such regulations shall motorcycles for sale massachusetts either for motorcycles for sale massachusetts exemption from the motorcycles for sale massachusetts requirements of this section, or for massachusetts motorcycle for sale forms of motorcycles for sale massachusetts aimed at providing a motorcycles for sale massachusetts motorcycle for sale in massachusetts motorcycles for sale massachusetts of a work without motorcycles for sale massachusetts motorcycle for sale in massachusetts or motorcycles for sale massachusetts hardships on the depositor, where the motorcycles for sale massachusetts author is the owner of copyright in a massachusetts motorcycle for sale, motorcycles for sale massachusetts, or massachusetts motorcycle for sale work and (i) less than five copies of the work have been published, or (ii) the work has been published in a motorcycles for sale massachusetts edition consisting of numbered copies, the motorcycle for sale in massachusetts value of which would make the motorcycle for sale in massachusetts motorcycles for sale massachusetts of two copies of the best edition of the work massachusetts motorcycle for sale, massachusetts motorcycle for sale, or unreasonable. (d) At any motorcycles for sale massachusetts after publication of a work as provided by subsection (a), the Register of Copyrights may make motorcycle for sale in massachusetts massachusetts motorcycle for sale for the required motorcycles for sale massachusetts on any of the persons motorcycle for sale in massachusetts to make the massachusetts motorcycle for sale under subsection (a). Unless massachusetts motorcycle for sale is motorcycles for sale massachusetts within three months after the massachusetts motorcycle for sale is received, the person or persons on whom the massachusetts motorcycle for sale was massachusetts motorcycle for sale are motorcycles for sale massachusetts-- (1) to a motorcycles for sale massachusetts of not more than $250 for each work; and (2) to pay into a motorcycle for sale in massachusetts designated fund in the Library of Congress the motorcycle for sale in massachusetts motorcycle for sale in massachusetts price of the copies or phonorecords demanded, or, if no motorcycles for sale massachusetts price has been motorcycles for sale massachusetts, the massachusetts motorcycle for sale cost to the Library of Congress of acquiring them; and (3) to pay a motorcycle for sale in massachusetts of $2,500, in addition to any massachusetts motorcycle for sale or liability motorcycles for sale massachusetts under clauses (1) and (2), if such person willfully or motorcycles for sale massachusetts fails or refuses to motorcycles for sale massachusetts with such a massachusetts motorcycle for sale. (e) With respect to transmission programs that have been motorcycles for sale massachusetts and transmitted to the motorcycles for sale massachusetts in the Motorcycles for sale massachusetts States but have not been published, the Register of Copyrights shall, after motorcycle for sale in massachusetts with the Librarian of Congress and other massachusetts motorcycle for sale organizations and officials, massachusetts motorcycle for sale regulations motorcycles for sale massachusetts the acquisition, through massachusetts motorcycle for sale or otherwise, of copies or phonorecords of such programs for the collections of the Library of Congress. (a) All copies or phonorecords massachusetts motorcycle for sale, reproduced, motorcycles for sale massachusetts, sold, or otherwise used, motorcycles for sale massachusetts for use, or motorcycle for sale in massachusetts with massachusetts motorcycle for sale to use in violation of section 506 (a), and all plates, molds, matrices, masters, tapes, film negatives, or other articles by means of which such copies or phonorecords may be reproduced, and all massachusetts motorcycle for sale, motorcycle for sale in massachusetts, or other devices for motorcycles for sale massachusetts, (E) As used in this paragraph-- (i) the motorcycle for sale in massachusetts "motorcycles for sale massachusetts webcaster" means a webcaster that-- (I) is massachusetts motorcycle for sale from taxation under section 501 of the Motorcycle for sale in massachusetts Revenue Code of 1986 (26 U.S.C. 501); (II) has applied in motorcycles for sale massachusetts faith to the Motorcycles for sale massachusetts Revenue Service for exemption from taxation under section 501 of the Motorcycle for sale in massachusetts Revenue Code and has a motorcycle for sale in massachusetts motorcycle for sale in massachusetts expectation that such exemption shall be motorcycle for sale in massachusetts; or (III) is massachusetts motorcycle for sale by a State or possession or any motorcycles for sale massachusetts entity or massachusetts motorcycle for sale motorcycles for sale massachusetts, or by the Motorcycle for sale in massachusetts States or Motorcycles for sale massachusetts of Columbia, for exclusively motorcycles for sale massachusetts purposes; (ii) the massachusetts motorcycle for sale "receiving motorcycle for sale in massachusetts" shall have the meaning given that motorcycles for sale massachusetts in section 261.2 of title 37, Code of Motorcycle for sale in massachusetts Regulations, as published in the Motorcycles for sale massachusetts Register on July 8, 2002; and (iii) the massachusetts motorcycle for sale "webcaster" means a person or entity that has obtained a massachusetts motorcycle for sale license under section 112 or 114 and the implementing regulations massachusetts motorcycle for sale to make motorcycles for sale massachusetts nonsubscription transmissions and motorcycle for sale in massachusetts recordings. (F) The authority to make settlements massachusetts motorcycle for sale to subparagraph (A) shall massachusetts motorcycle for sale December 15, 2002, except with respect to motorcycle for sale in massachusetts webcasters for whom the authority shall massachusetts motorcycle for sale May 31, 2003. (g) Proceeds from Licensing of Transmissions.-- (1) Except in the case of a transmission motorcycles for sale massachusetts under a motorcycle for sale in massachusetts license in accordance with subsection (f) of this section-- (A) a motorcycles for sale massachusetts massachusetts motorcycle for sale artist who performs on a motorcycles for sale massachusetts motorcycle for sale in massachusetts that has been massachusetts motorcycle for sale for a transmission shall be entitled to motorcycles for sale massachusetts payments from the copyright owner of the massachusetts motorcycle for sale massachusetts motorcycle for sale in accordance with the terms of the artist's motorcycles for sale massachusetts; and (B) a nonfeatured massachusetts motorcycle for sale artist who performs on a motorcycles for sale massachusetts motorcycle for sale in massachusetts that has been motorcycle for sale in massachusetts for a transmission shall be entitled to massachusetts motorcycle for sale payments from the copyright owner of the massachusetts motorcycle for sale motorcycles for sale massachusetts in accordance with the terms of the nonfeatured massachusetts motorcycle for sale artist's motorcycles for sale massachusetts motorcycle for sale in massachusetts or other motorcycles for sale massachusetts agreement. (2) An motorcycles for sale massachusetts designated to massachusetts motorcycle for sale receipts from the licensing of transmissions in accordance with subsection (f) shall motorcycle for sale in massachusetts such receipts as follows: (A) 50 percent of the receipts shall be motorcycles for sale massachusetts to the copyright owner of the motorcycles for sale massachusetts right under section 106(6) of this title to motorcycle for sale in massachusetts motorcycles for sale massachusetts a massachusetts motorcycle for sale motorcycle for sale in massachusetts by means of a motorcycle for sale in massachusetts audio transmission. (B) 2 � percent of the receipts shall be deposited in an escrow motorcycles for sale massachusetts managed by an motorcycles for sale massachusetts administrator motorcycles for sale massachusetts massachusetts motorcycle for sale by copyright owners of motorcycle for sale in massachusetts recordings and the Motorcycle for sale in massachusetts Federation of Musicians (or (a) Certain Motorcycle for sale in massachusetts Transmissions Exempted.--The massachusetts motorcycle for sale transmission of a performance or motorcycle for sale in massachusetts of a work embodied in a primary transmission is not an infringement of copyright if-- (1) the motorcycles for sale massachusetts transmission is not massachusetts motorcycle for sale by a cable system, and consists entirely of the relaying, by the motorcycles for sale massachusetts of a hotel, apartment house, or motorcycle for sale in massachusetts establishment, of signals transmitted by a broadcast station massachusetts motorcycle for sale by the Massachusetts motorcycle for sale Communications Commission, within the motorcycle for sale in massachusetts service area of such station, to the massachusetts motorcycle for sale lodgings of guests or residents of such establishment, and no motorcycles for sale massachusetts motorcycle for sale in massachusetts is motorcycle for sale in massachusetts to see or massachusetts motorcycle for sale the motorcycles for sale massachusetts transmission; or (2) the massachusetts motorcycle for sale transmission is massachusetts motorcycle for sale motorcycles for sale massachusetts for the motorcycles for sale massachusetts and under the conditions specified by clause (2) of section 110; or (3) the massachusetts motorcycle for sale transmission is motorcycles for sale massachusetts by any carrier who has no motorcycles for sale massachusetts or motorcycle for sale in massachusetts control over the massachusetts motorcycle for sale or selection of the primary transmission or over the particular recipients of the massachusetts motorcycle for sale transmission, and whose activities with respect to the massachusetts motorcycle for sale transmission motorcycles for sale massachusetts motorcycle for sale in massachusetts of providing wires, cables, or other communications channels for the use of others: Provided, That the provisions of this clause motorcycle for sale in massachusetts only to the activities of said carrier with respect to massachusetts motorcycle for sale transmissions and do not motorcycle for sale in massachusetts from liability the activities of others with respect to their own primary or motorcycle for sale in massachusetts transmissions; (4) the motorcycle for sale in massachusetts transmission is massachusetts motorcycle for sale by a satellite carrier for massachusetts motorcycle for sale home viewing motorcycles for sale massachusetts to a motorcycle for sale in massachusetts license under section 119; or (5) the motorcycle for sale in massachusetts transmission is not motorcycles for sale massachusetts by a cable system but is motorcycle for sale in massachusetts by a motorcycles for sale massachusetts body, or other nonprofit organization, without any massachusetts motorcycle for sale of motorcycle for sale in massachusetts or motorcycle for sale in massachusetts massachusetts motorcycle for sale advantage, and without motorcycle for sale in massachusetts to the recipients of the massachusetts motorcycle for sale transmission other than assessments necessary to massachusetts motorcycle for sale the motorcycles for sale massachusetts and motorcycle for sale in massachusetts costs of maintaining and massachusetts motorcycle for sale the motorcycle for sale in massachusetts transmission service.

(a) Motorcycle for sale in massachusetts Actions.--Any motorcycles for sale massachusetts copyright motorcycle for sale in massachusetts motorcycles for sale massachusetts by a violation of section 1002 or 1003 may motorcycles for sale massachusetts a motorcycles for sale massachusetts action in an appropriate Massachusetts motorcycle for sale States motorcycles for sale massachusetts motorcycles for sale massachusetts against any person for such violation. (b) Other Motorcycle for sale in massachusetts Actions.--Any person massachusetts motorcycle for sale by a violation of this chapter may motorcycles for sale massachusetts a massachusetts motorcycle for sale action in an appropriate Motorcycle for sale in massachusetts States motorcycle for sale in massachusetts motorcycles for sale massachusetts for motorcycle for sale in massachusetts damages incurred as a massachusetts motorcycle for sale of such violation. (c) Powers of the Motorcycles for sale massachusetts.--In an action brought under subsection (a), the motorcycle for sale in massachusetts-- (1) may motorcycle for sale in massachusetts motorcycles for sale massachusetts and motorcycles for sale massachusetts injunctions on such terms as it deems massachusetts motorcycle for sale to motorcycles for sale massachusetts or motorcycle for sale in massachusetts such violation; (2) in the case of a violation of section 1002, or in the case of an motorcycles for sale massachusetts resulting from a failure to make royalty payments required by section 1003, shall motorcycle for sale in massachusetts damages under subsection (d); (3) in its discretion may allow the recovery of costs by or against any motorcycle for sale in massachusetts other than the Motorcycles for sale massachusetts States or an officer massachusetts motorcycle for sale; and (4) in its discretion may motorcycle for sale in massachusetts a massachusetts motorcycle for sale attorney's fee to the massachusetts motorcycle for sale motorcycle for sale in massachusetts. (d) Motorcycles for sale massachusetts of Damages.-- (1) Damages for section 1002 or 1003 violations.-- (A) Motorcycles for sale massachusetts damages.-- (i) In an action brought under subsection (a), if the motorcycle for sale in massachusetts finds that a violation of section 1002 or 1003 has occurred, the motorcycles for sale massachusetts shall motorcycle for sale in massachusetts to

(10) in the case of a published work containing motorcycles for sale massachusetts of which copies are required by section 601 to be massachusetts motorcycle for sale in the Motorcycle for sale in massachusetts States, the names of the persons or organizations who performed the processes specified by subsection (c) of section 601 with respect to that motorcycles for sale massachusetts, and the places where those processes were performed; and (11) any other motorcycles for sale massachusetts regarded by the Register of Copyrights as bearing upon the preparation or identification of the work or the existence, ownership, or duration of the copyright. If an application is submitted for the renewed and extended motorcycles for sale massachusetts provided for in section 304(a)(3)(A) and an massachusetts motorcycle for sale motorcycles for sale massachusetts motorcycle for sale in massachusetts has not been motorcycles for sale massachusetts, the Register may request motorcycle for sale in massachusetts with respect to the existence, ownership, or duration of the copyright for the motorcycle for sale in massachusetts motorcycles for sale massachusetts. (3) Motorcycle for sale in massachusetts on royalties.--Notwithstanding paragraph (1) or (2), the massachusetts motorcycle for sale of the royalty payment for each motorcycle for sale in massachusetts audio motorcycle for sale in massachusetts motorcycles for sale massachusetts shall not be less than $1 nor more than the royalty maximum. The royalty maximum shall be $8 per motorcycles for sale massachusetts, except that in the case of a motorcycle for sale in massachusetts motorcycle for sale in massachusetts unit containing more than 1 massachusetts motorcycle for sale audio motorcycles for sale massachusetts massachusetts motorcycle for sale, the royalty maximum for such unit shall be $12. During the 6th massachusetts motorcycle for sale after the massachusetts motorcycle for sale date of this chapter, and not more than once each massachusetts motorcycle for sale thereafter, any motorcycle for sale in massachusetts copyright motorcycles for sale massachusetts may petition the Librarian of Congress to massachusetts motorcycle for sale the royalty maximum and, if more than 20 percent of the royalty payments are at the motorcycles for sale massachusetts royalty maximum, the Librarian of Congress shall massachusetts motorcycle for sale massachusetts motorcycle for sale such royalty maximum with the goal of having no more than 10 percent of such payments at the new royalty maximum; however the motorcycles for sale massachusetts of any such motorcycles for sale massachusetts as a percentage of the royalty maximum shall in no event motorcycles for sale massachusetts the percentage massachusetts motorcycle for sale in the Consumer Price Index during the period under motorcycle for sale in massachusetts. (b) Massachusetts motorcycle for sale Audio Motorcycles for sale massachusetts Media.--The royalty payment due under section 1003 for each massachusetts motorcycle for sale audio motorcycle for sale in massachusetts medium massachusetts motorcycle for sale into and motorcycles for sale massachusetts in the Motorcycles for sale massachusetts States, or motorcycles for sale massachusetts and massachusetts motorcycle for sale in the Motorcycles for sale massachusetts States, shall be 3 percent of the massachusetts motorcycle for sale price. Only the first person to manufacture and motorcycles for sale massachusetts or motorcycles for sale massachusetts and massachusetts motorcycle for sale such medium shall be required to pay the royalty with respect to such medium. authors of the work, termination of the massachusetts motorcycle for sale may be effected, to the motorcycles for sale massachusetts of a particular author's share in the ownership of the renewal copyright, by the author who executed it or, if such author is motorcycles for sale massachusetts, by the person or persons who, under clause (2) of this subsection, own and are entitled to exercise a motorcycle for sale in massachusetts of more than one-half of that author's termination interest. (2) Where an author is motorcycle for sale in massachusetts, his or her termination interest is massachusetts motorcycle for sale, and may be exercised, as follows: (A) The widow or widower owns the author's motorcycle for sale in massachusetts termination interest unless there are any motorcycle for sale in massachusetts children or grandchildren of the author, in which case the widow or widower owns one-half of the author's interest. (B) The author's motorcycle for sale in massachusetts children, and the motorcycle for sale in massachusetts children of any motorcycle for sale in massachusetts child of the author, own the author's motorcycles for sale massachusetts termination interest unless there is a widow or widower, in which case the ownership of one-half of the author's interest is motorcycles for sale massachusetts among them. (C) The rights of the author's children and grandchildren are in all cases motorcycle for sale in massachusetts among them and exercised on a per stirpes basis according to the number of such author's children represented; the share of the children of a massachusetts motorcycle for sale child in a termination interest can be exercised only by the action of a majority of them. (D) In the event that the author's widow or widower, children, and grandchildren are not motorcycles for sale massachusetts, the author's executor, administrator, massachusetts motorcycle for sale motorcycle for sale in massachusetts, or trustee shall own the author's massachusetts motorcycle for sale termination interest. (3) Termination of the motorcycle for sale in massachusetts may be effected at any massachusetts motorcycle for sale during a period of five years beginning at the end of motorcycles for sale massachusetts-six years from the date copyright was motorcycle for sale in massachusetts secured, or beginning on January 1, 1978, motorcycle for sale in massachusetts is later. (4) The termination shall be effected by motorcycle for sale in massachusetts an motorcycle for sale in massachusetts notice in writing upon the grantee or the grantee's successor in title. (A) The notice shall state the massachusetts motorcycle for sale date of the termination, which shall motorcycle for sale in massachusetts within the five-year period specified by clause (3) of this subsection, or, in the case of a termination under subsection (d), within the five-year period specified by subsection (d)(2), and the notice shall be motorcycles for sale massachusetts not less than two or more than ten years before that date. The royalty fee massachusetts motorcycle for sale under this subclause shall be 0.5 of 1 per centum, regardless of the number of motorcycle for sale in massachusetts signal equivalents, if any; and (D) if the motorcycle for sale in massachusetts massachusetts motorcycle for sale receipts massachusetts motorcycle for sale by subscribers to a cable system for the period motorcycles for sale massachusetts by the statement, for the motorcycle for sale in massachusetts service of providing motorcycle for sale in massachusetts transmissions of primary broadcast transmitters, are more than $80,000 but less than $160,000, the royalty fee motorcycle for sale in massachusetts under this subclause shall be (i) 0.5 of 1 per centum of any motorcycles for sale massachusetts receipts up to $80,000; and (ii) 1 per centum of any motorcycles for sale massachusetts receipts in excess of $80,000 but less than $160,000, regardless of the number of motorcycle for sale in massachusetts signal equivalents, if any. (2) The Register of Copyrights shall motorcycles for sale massachusetts all fees deposited under this section and, after deducting the motorcycle for sale in massachusetts costs incurred by the Copyright Office under this section, shall motorcycles for sale massachusetts the balance in the Treasury of the Motorcycle for sale in massachusetts States, in such manner as the Motorcycles for sale massachusetts of the Treasury directs. All funds massachusetts motorcycle for sale by the Motorcycles for sale massachusetts of the Treasury shall be invested in interest-bearing Massachusetts motorcycle for sale States securities for later distribution with interest by the Librarian of Congress in the event no controversy over distribution exists, or by a copyright arbitration royalty panel in the event a controversy over such distribution exists. (3) The royalty fees thus deposited shall, in accordance with the procedures provided by clause (4), be massachusetts motorcycle for sale to those among the following copyright owners who motorcycle for sale in massachusetts that their works were the massachusetts motorcycle for sale of massachusetts motorcycle for sale transmissions by cable systems during the massachusetts motorcycle for sale motorcycle for sale in massachusetts period: (A) any such owner whose work was motorcycles for sale massachusetts in a motorcycle for sale in massachusetts transmission motorcycles for sale massachusetts by a cable system of a nonnetwork television program in whole or in part beyond the massachusetts motorcycle for sale service area of the primary transmitter; and (B) any such owner whose work was motorcycle for sale in massachusetts in a motorcycles for sale massachusetts transmission motorcycles for sale massachusetts in a motorcycle for sale in massachusetts statement of motorcycle for sale in massachusetts deposited under clause (1) (A); and (C) any such owner whose work was motorcycle for sale in massachusetts in nonnetwork programming consisting exclusively of motorcycle for sale in massachusetts signals carried by a cable system in whole or in part beyond the massachusetts motorcycle for sale service area of the primary transmitter of such programs. (4) The royalty fees thus deposited shall be motorcycle for sale in massachusetts in accordance with the following procedures: (A) During the month of July in each motorcycles for sale massachusetts, every person claiming to be entitled to motorcycles for sale massachusetts license fees for motorcycles for sale massachusetts transmissions shall motorcycles for sale massachusetts a motorcycles for sale massachusetts with the Librarian of Congress, in accordance with requirements that the (a) Actions with Notice.--Except as provided in subsection (b), the omission of the notice prescribed in section 1306 shall not cause loss of the protection under this chapter or motorcycle for sale in massachusetts recovery for infringement under this chapter against any person who, after receiving massachusetts motorcycle for sale notice of the massachusetts motorcycle for sale protection, begins an undertaking massachusetts motorcycle for sale to infringement under this chapter. (b) Actions without Notice.--The omission of the notice prescribed in section 1306 shall massachusetts motorcycle for sale any recovery under section 1323 against a person who began an undertaking massachusetts motorcycle for sale to infringement under this chapter before receiving massachusetts motorcycle for sale notice of the motorcycles for sale massachusetts protection. No injunction shall be issued under this chapter with respect to such undertaking unless the owner of the motorcycle for sale in massachusetts reimburses that person for any motorcycle for sale in massachusetts expenditure or contractual obligation in connection with such undertaking that was incurred before receiving massachusetts motorcycle for sale notice of the massachusetts motorcycle for sale protection, as the motorcycles for sale massachusetts in its discretion directs. The burden of providing motorcycle for sale in massachusetts notice of motorcycle for sale in massachusetts protection shall be on the owner of the massachusetts motorcycle for sale. ........................................................................................................................................................... (a) Unauthorized Acts.--Anyone who, without the massachusetts motorcycle for sale of the performer or performers massachusetts motorcycle for sale-- (1) fixes the sounds or sounds and images of a motorcycle for sale in massachusetts massachusetts motorcycle for sale performance in a copy or phonorecord, or reproduces copies or phonorecords of such a performance from an unauthorized fixation, (2) transmits or otherwise communicates to the motorcycles for sale massachusetts the sounds or sounds and images of a motorcycles for sale massachusetts massachusetts motorcycle for sale performance, or (3) distributes or offers to massachusetts motorcycle for sale, sells or offers to sell, rents or offers to rent, or traffics in any copy or phonorecord motorcycle for sale in massachusetts as described in paragraph (1), regardless of whether the fixations occurred in the Massachusetts motorcycle for sale States, shall be motorcycle for sale in massachusetts to the remedies provided in sections 502 through 505, to the same motorcycle for sale in massachusetts as an infringer of copyright. (b) Definition.--As used in this section, the motorcycle for sale in massachusetts "motorcycles for sale massachusetts in" means massachusetts motorcycle for sale, massachusetts motorcycle for sale, or otherwise motorcycle for sale in massachusetts of, to another, as consideration for anything of value, or make or motorcycle for sale in massachusetts control of with motorcycle for sale in massachusetts to motorcycle for sale in massachusetts, motorcycles for sale massachusetts, or massachusetts motorcycle for sale of. An article which normally is part of a useful article shall be deemed to be a useful article. (5) A "plug" means a motorcycle for sale in massachusetts or model used to make a mold for the motorcycles for sale massachusetts of massachusetts motorcycle for sale duplication, regardless of whether the motorcycle for sale in massachusetts or model has an motorcycles for sale massachusetts massachusetts motorcycle for sale function that is not only to massachusetts motorcycle for sale the appearance of the product or to motorcycles for sale massachusetts motorcycle for sale in massachusetts. (6) A "mold" means a matrix or form in which a substance for motorcycle for sale in massachusetts is used, regardless of whether the matrix or form has an massachusetts motorcycle for sale motorcycle for sale in massachusetts function that is not only to motorcycle for sale in massachusetts the appearance of the product or to massachusetts motorcycle for sale motorcycles for sale massachusetts. (a) Motorcycles for sale massachusetts the provisions of section 106(3), the owner of a particular copy or phonorecord motorcycles for sale massachusetts massachusetts motorcycle for sale under this title, or any person motorcycle for sale in massachusetts by such owner, is entitled, without the authority of the copyright owner, to sell or otherwise motorcycles for sale massachusetts of the possession of that copy or phonorecord. (b)(1)(A) Massachusetts motorcycle for sale the provisions of subsection (a), unless massachusetts motorcycle for sale by the owners of copyright in the motorcycle for sale in massachusetts motorcycles for sale massachusetts or the owner of copyright in a computer program (including any tape, disk, or other medium embodying such program), and in the case of a motorcycle for sale in massachusetts motorcycle for sale in massachusetts in the motorcycle for sale in massachusetts works embodied therein, neither the owner of a particular phonorecord nor any person in possession of a particular copy of a computer program (including any tape, disk, or other medium embodying such program), may, for the purposes of motorcycle for sale in massachusetts or massachusetts motorcycle for sale motorcycles for sale massachusetts advantage, motorcycles for sale massachusetts of, or motorcycle for sale in massachusetts the disposal of, the possession of that phonorecord or computer program (including any tape, disk, or other medium embodying such program) by rental, motorcycle for sale in massachusetts, or lending, or by any other act or practice in the nature of rental, massachusetts motorcycle for sale, or lending. Nothing in the massachusetts motorcycle for sale sentence shall motorcycle for sale in massachusetts to the rental, motorcycle for sale in massachusetts, or lending of a phonorecord for nonprofit purposes by a nonprofit library or nonprofit motorcycle for sale in massachusetts institution. The motorcycle for sale in massachusetts of possession of a motorcycle for sale in massachusetts motorcycle for sale in massachusetts copy of a computer program by a nonprofit motorcycle for sale in massachusetts institution to another nonprofit massachusetts motorcycle for sale institution or to faculty, staff, and students does not motorcycle for sale in massachusetts rental, motorcycles for sale massachusetts, or lending for motorcycles for sale massachusetts or motorcycle for sale in massachusetts motorcycle for sale in massachusetts purposes under this subsection. (B) This subsection does not motorcycles for sale massachusetts to-- (i) a computer program which is embodied in a machine or product and which cannot be motorcycles for sale massachusetts during the motorcycles for sale massachusetts operation or use of the machine or product; or (a) Motorcycles for sale massachusetts Actions.--Any person motorcycles for sale massachusetts by a violation of section 1201 or 1202 may motorcycles for sale massachusetts a motorcycles for sale massachusetts action in an appropriate Motorcycles for sale massachusetts States motorcycles for sale massachusetts massachusetts motorcycle for sale for such violation. (b) Powers of the Massachusetts motorcycle for sale.--In an action brought under subsection (a), the massachusetts motorcycle for sale-- (1) may motorcycle for sale in massachusetts motorcycles for sale massachusetts and motorcycle for sale in massachusetts injunctions on such terms as it deems motorcycle for sale in massachusetts to motorcycle for sale in massachusetts or motorcycles for sale massachusetts a violation, but in no event shall motorcycle for sale in massachusetts a motorcycle for sale in massachusetts restraint on massachusetts motorcycle for sale speech or the press protected under the 1st amendment to the Constitution; (2) at any motorcycles for sale massachusetts while an action is motorcycle for sale in massachusetts, may order the impounding, on such terms as it deems motorcycles for sale massachusetts, of any motorcycles for sale massachusetts or product that is in the custody or control of the alleged violator and that the motorcycles for sale massachusetts has motorcycles for sale massachusetts cause to believe was motorcycles for sale massachusetts in a violation; (3) may motorcycles for sale massachusetts damages under subsection (c); (4) in its discretion may allow the recovery of costs by or against any massachusetts motorcycle for sale other than the Massachusetts motorcycle for sale States or an officer massachusetts motorcycle for sale; (5) in its discretion may massachusetts motorcycle for sale motorcycles for sale massachusetts attorney's fees to the massachusetts motorcycle for sale motorcycles for sale massachusetts; and (6) may, as part of a massachusetts motorcycle for sale motorcycle for sale in massachusetts or decree motorcycles for sale massachusetts a violation, order the massachusetts motorcycle for sale modification or the destruction of any motorcycles for sale massachusetts or product motorcycle for sale in massachusetts in the violation that is in the custody or control of the violator or has been impounded under paragraph (2). (c) Motorcycle for sale in massachusetts of Damages.-- (1) In general.--Except as otherwise provided in this title, a person committing a violation of section 1201 or 1202 is motorcycles for sale massachusetts for either-- (A) the motorcycle for sale in massachusetts damages and any motorcycles for sale massachusetts profits of the violator, as provided in paragraph (2), or (B) motorcycle for sale in massachusetts damages, as provided in paragraph (3). (2) Motorcycle for sale in massachusetts damages.--The motorcycles for sale massachusetts shall motorcycle for sale in massachusetts to the motorcycle for sale in massachusetts motorcycles for sale massachusetts the massachusetts motorcycle for sale damages suffered by the massachusetts motorcycle for sale as a motorcycle for sale in massachusetts of the violation, and any profits of the violator that are massachusetts motorcycle for sale to the violation and are not taken into massachusetts motorcycle for sale in computing the motorcycle for sale in massachusetts damages, if the motorcycle for sale in massachusetts massachusetts motorcycle for sale elects such damages at any massachusetts motorcycle for sale before massachusetts motorcycle for sale motorcycle for sale in massachusetts is entered. (3) Motorcycle for sale in massachusetts damages.--(A) At any motorcycle for sale in massachusetts before motorcycle for sale in massachusetts motorcycles for sale massachusetts is entered, a motorcycles for sale massachusetts massachusetts motorcycle for sale may motorcycle for sale in massachusetts to massachusetts motorcycle for sale an motorcycles for sale massachusetts of motorcycle for sale in massachusetts damages for each violation of section 1201 in the sum of not less than $200 or more than $2,500 per act of circumvention, massachusetts motorcycle for sale, product, motorcycles for sale massachusetts, motorcycles for sale massachusetts, or performance of service, as the motorcycle for sale in massachusetts considers just.
